Uncontested Divorce: An Amicable Path to Separation

Uncontested divorce offers a streamlined and cost-effective approach to ending a marriage when both spouses can agree on key issues such as property division, child custody, and support arrangements. It typically involves less time in court, lower legal fees, and reduced emotional stress compared to a contested divorce. At our firm, we specialize in guiding clients through the uncontested divorce process, ensuring that all necessary paperwork is correctly filed and that both parties fully understand the terms of their divorce agreement. Our goal is to facilitate a swift and amicable resolution that allows both individuals to move forward with their lives in a more harmonious manner. If you and your spouse are considering an uncontested divorce, we're here to provide the legal support and guidance you need to make the process as smooth as possible.

Uncontested Divorce

Uncontested divorces offer quicker resolutions, lower costs, and reduced emotional strain compared to contested divorces…

Uncontested Divorces vs. Contested Divorces

If you and your spouse are seeking a divorce and believe you agree to the terms of that divorce, you may want to consider an “uncontested divorce”. An uncontested divorce is a quicker, cheaper, and a less emotionally taxing option than a traditional divorce.

The process for an uncontested divorce looks like this:

Divorce

The rough timeline for this process is 3-4 months, accounting for the 60-day waiting period that is required by the State of Texas prior to finalizing the divorce.

Benefits of an Uncontested Divorce

A traditional divorce can take months, even years, and cost thousands of dollars. The process often includes multiple court hearings, evaluations, a process called discovery, and can become very time consuming and overwhelming.

The biggest advantage is cost. Uncontested divorces are generally much less expensive than contested divorces. When the parties are in agreement the attorney’s fees necessary to complete the divorce can be kept lower than when the parties’ resort to court. Often the only other fess are court fees and copies.

Where to Start?

An uncontested divorce requires both parties to work together to come to agreement. Although speaking to a lawyer is always advised, having a general working knowledge of the issues that need to be discussed and worked through at the outset is a good way to get the process started, or to see if it is even possible to come to an agreement.
